These Terms and Conditions (“Terms”) govern your use of the services provided by Kitchen Cubby (“we,” “our,” or “us”). By renting space or using any services offered by Kitchen Cubby, you (“Client” or “you”) agree to comply with these Terms. Please read them carefully.
1. Services Provided
Kitchen Cubby offers rental of kitchen space, equipment, and storage facilities for food trucks, trailers, and small food vendors. We provide:
- Kitchen Space: Over 800 square feet of kitchen space, available for rent on an hourly, daily, or monthly basis.
- Storage: Dry, cold, and frozen storage options.
- Parking: Heated indoor parking with 12×18 bay doors, along with ample outdoor parking.
- Customizable Rental Packages: Rental agreements tailored to your specific needs.
We also offer support from our knowledgeable staff to help you grow your business.
2. Rental Terms
- Eligibility: To rent space or services at Kitchen Cubby, you must be a registered business or food vendor with the proper permits and licenses to operate.
- Rental Period: Rental periods are based on your chosen package (hourly, daily, monthly) and must be agreed upon in writing at the time of booking.
- Payment: Payment is due prior to the start of your rental period unless otherwise agreed. Accepted methods of payment include credit/debit cards or other payment arrangements as agreed in writing.
- Late Fees: Any overdue payments will incur a late fee as specified in your rental agreement.
3. Use of Kitchen Space
- Permitted Use: The kitchen space and equipment are for food preparation purposes only. The use of the kitchen for any activity outside the scope of food production is strictly prohibited.
- Cleaning and Maintenance: Clients are required to clean the kitchen space and equipment after each use. A cleaning fee may apply if the kitchen is not left in acceptable condition.
- Equipment: Clients are responsible for the proper use and care of all equipment provided. Any damage to equipment must be reported immediately, and the Client may be charged for repairs or replacement.
4. Storage and Parking
- Storage: Clients are responsible for ensuring that their stored items are properly labeled and comply with health and safety regulations. Kitchen Cubby is not responsible for any loss or damage to items stored in the dry, cold, or frozen storage units.
- Parking: Clients may use the heated indoor parking area and outdoor parking spaces as needed. Parking must be done in designated areas, and the 12×18 bay doors must remain clear for safety and operational purposes.
5. Health and Safety Compliance
- Permits and Licenses: Clients must maintain all necessary permits and licenses to operate legally. Clients must also adhere to all local, state, and federal health, safety, and food handling regulations while using the Kitchen Cubby facilities.
- Inspection and Compliance: Kitchen Cubby reserves the right to inspect your kitchen operations and storage areas to ensure compliance with health and safety standards. Any non-compliance may result in the termination of your rental agreement.
6. Indemnification and Liability
- Liability: Kitchen Cubby is not responsible for any injuries, damages, or losses sustained by the Client or any third parties while using the facilities. The Client agrees to use the facilities at their own risk.
- Indemnity: The Client agrees to indemnify and hold Kitchen Cubby harmless from any claims, damages, or liabilities arising from the Client’s use of the facilities, including any violation of laws, regulations, or these Terms.
7. Cancellation and Termination
- Cancellation Policy: Rental cancellations must be made at least 24 hours in advance for a full refund. Cancellations made less than 24 hours before the scheduled rental period may be subject to a cancellation fee.
- Termination: Kitchen Cubby reserves the right to terminate any rental agreement without notice if the Client violates these Terms, engages in unlawful activities, or endangers the safety or well-being of other tenants or staff.
8. Amendments to Terms
Kitchen Cubby reserves the right to update or modify these Terms at any time. Clients will be notified of significant changes, and continued use of the facilities after changes are made will constitute acceptance of the updated Terms.
9. Privacy and Confidentiality
All personal and business information provided by Clients will be handled in accordance with our Privacy Policy (available on our website). We are committed to protecting your privacy and maintaining the confidentiality of any business information shared with us.
10. Dispute Resolution
Any disputes arising from these Terms or the use of our services will be resolved through informal negotiations. If the dispute cannot be resolved informally, it will be submitted to binding arbitration in accordance with the laws of the state in which Kitchen Cubby operates.
